These Terms of Service ("Terms") govern your access to and use of the Golfapedia website, interactive 3D golf course tours, directory, and related services (collectively, the "Service"), operated by Golfapedia ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Golfapedia provides searchable golf course information and immersive, photoreal 3D course tours, along with tools for golf clubs and travel businesses to embed those tours on their own websites. The Service is provided on an "as is" and "as available" basis, and we may update, change, suspend, or discontinue any part of it at any time.
You agree not to misuse the Service. In particular, you will not:
We may rate-limit, block, suspend, or terminate access that violates these Terms or threatens the integrity, security, or availability of the Service.
Pricing and license terms for embedding are provided at the point of purchase on licensing.golfapedia.org, where checkout and billing are handled securely by Stripe. The first-year launch package includes the first year of service; thereafter the license renews annually at the then-current renewal price unless canceled. Questions about licensing can be directed to licensing@golfapedia.org. Except where required by law, fees paid are non-refundable. We may change pricing prospectively.
The Service, including its software, 3D tour geometry and imagery, design, text, graphics, and the Golfapedia name and logo, is owned by us or our licensors and is protected by intellectual-property laws. Except for the limited embedding rights granted by a valid license key, no rights are transferred to you. Course names and trademarks belong to their respective owners and are used for identification only.
If you submit feedback, suggestions, or other content, you grant us a non-exclusive, worldwide, royalty-free license to use it to operate and improve the Service. You are responsible for ensuring you have the rights to any content or course information you provide to us for inclusion.
The Service relies on third-party providers (for example, Microsoft Azure, Google Maps Platform, Cesium ion, Cloudflare/cdnjs, and OpenAI). Your use of features that depend on those providers is also subject to their terms. We are not responsible for third-party services or websites linked from the Service.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that course data, distances, maps, or AI-generated output are accurate or complete. Do not rely on the Service for safety-critical decisions.
To the maximum extent permitted by law, Golfapedia and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of (or inability to use) the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or USD $100.
You agree to indemnify and hold harmless Golfapedia and its operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your content, or your violation of these Terms or any law or third-party right.
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect information.
We may suspend or terminate your access to the Service (including any license keys) at any time if you violate these Terms or to protect the Service. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will survive.
These Terms are governed by the laws of the United States and the State in which we operate, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located there for any dispute not subject to mandatory local consumer-protection law.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
